How should I fill out Form W-8eci? What is the purpose of Form W-8eci? The purpose of Forms W-8eci and W-8(D) is to show to the Department of the Treasury information to assist in its determination as described in the Instructions for Forms W-8 and W-8(D). An individual must furnish information to the Department of the Treasury or the designated financial institution in a manner that is satisfactory to the designated financial institution for purposes of Forms W-8 and W-8(D), if, at the time of filing the return, the amount of Federal Income Tax includes, and the amount of Adjusted Gross Income does not include, payments on an installment agreement. The information furnished should disclose the nature and the amount of such payments. The information furnished should be sufficient to permit the Department of the Treasury to determine whether any tax, penalties and interest has been paid. The Department of the Treasury has no liability for the correctness of any such information furnished. The designated financial institutions accept payments received from individuals and organizations by wire or electronic mail unless it is impracticable to do so. Any request for information should be made for the specific purpose of obtaining information to support a request for an income tax refund or an itemized deduction. Information about the form a return was filed on and the nature of the taxpayer's income, deductions, credits or exemption is not relevant in assessing the validity of any such claim. Any person having knowledge reasonably relating to the correctness of any information furnished should notify the Department of the Treasury's designated financial institution as soon as reasonably practicable of any such errors or omissions and furnish such information as soon as practicable. The designated financial institution should promptly notify the individual whose income tax return was erroneous, and the individual's designated financial institution should notify the Department of the Treasury of all refunds received. The Department of the Treasury's Form 5471 also indicates what type of person is being required to provide information to the Department of the Treasury. The Form 5471 indicates, among other things, that individuals are not required to furnish income tax returns when the person furnishing the information is not a financial institution. Similarly, Form 5472 indicates that a person not located within the United States is not required to furnish information to the department when the person furnishing the return is not a financial institution or its agents, but is acting as a trustee or adviser to an individual described in section 5472.
Who should complete Form W-8eci?
Form W-8eci is intended for those employees whose principal occupations are listed in Schedule C (Form 1040) and with an annual salary of 120,000 or more in the pay period. However, if you filed Form 1040-MISC by paper or as a hard copy, you will need to make a paper entry showing the date of your filing, and you should file Form 1040-MISC in April You are over age 18 You are a nonresident alien spouse or eligible dependent You made a personal income tax return for the tax year that included dates prior to January 1, 1997,, and you filed it electronically on or before April 15, 2000; You filed your tax return by paper or as a hard copy You were issued a Form W-8ECI that includes a “California address” in order to be qualified as domiciled in California when filing a Form 1040-MISC; You were issued a Form W-8ECI during the 1-year period beginning on October 1, 1999, and ending on the last day of the last month of the 1st year following the calendar year in which you paid your income tax; and You were issued a Form W-8ECI on or before April 15, 2000, when filing a Form 1040-MISC. Therefore, filing your tax return electronically during the 1-year period ending on the last day of the 3rd month before the first day of the 4th month preceding the calendar year, or filing a Form 1040-MISC in April of the calendar year in which you owe the tax, is sufficient to meet the residency requirement.

If the taxpayer does not file a Form W-8eci by the deadline, you can expect the following consequences: If the taxpayer uses Form W-8eci, you will not be able to withhold tax on an FICA tax rebate because the amount of tax for which they were eligible is not included in the total amount of income subject to tax on Form 1040, Line 14. Form W-8eci indicates that an income tax return or a return for the 2017 tax year, or a tax-free rollover would have been required for the recipient to claim the refund. If you do not withhold tax on the amount of income tax that qualifies as a W-8ECI, the withholding rate for the tax year is generally 27.64%. If you issue Form 8809 or Form 8810 to the recipient, you are not required to withhold any tax (including foreign tax) on this amount. The tax may be paid by the individual who received the Form 8809 or Form 8810. If you use Form 8809 or Form 8810 to withhold tax on a W-8ECI, you generally must attach Form 1040X or Form 1040NR (or Form 1040NR-EZ) to the return for the year or report the full amount of withholding tax on Form 1040 or Form 1040A.
